Welcome to Mirqavo.com. These Terms and Conditions ("Terms") govern your access to and use of the Mirqavo online store and the purchase of products offered through the website.
By placing an order through Mirqavo.com, you acknowledge that you have read and understood these Terms and agree to be bound by them, to the extent permitted by applicable law.
1. Seller Information
The Mirqavo online store is currently operated as a test-stage online retail project.
Once the business has been formally registered, the legal seller information will be updated accordingly.
Nothing in these Terms excludes or restricts any mandatory consumer rights applicable under the laws governing your purchase.
2. Products
Mirqavo primarily sells bathroom and interior mirrors, including mirrors equipped with LED lighting and anti-fog/heating functionality.
Product specifications, dimensions, colors, features and other characteristics are described on the relevant product page.
We make reasonable efforts to ensure that product descriptions, images and specifications are accurate. However, minor differences in color, appearance or presentation may occur depending on the customer's display, lighting conditions or photographic conditions.
The actual product supplied shall be the relevant model and specification stated in the order.
3. Electrical Products
Some Mirqavo products contain electrical components, including LED lighting and anti-fog/heating functions.
Products supplied with an EU-compatible plug are intended to be connected to a suitable electrical socket in accordance with the manufacturer's instructions.
Unless expressly stated otherwise:
- Mirqavo does not provide professional electrical installation services;
- Mirqavo does not provide wall installation or mounting services;
- the customer is responsible for ensuring that the intended installation location and electrical socket are suitable;
- customers must follow all manufacturer instructions and safety warnings supplied with the product;
- customers must not modify, disassemble or alter the electrical components of the product;
- damaged electrical products must not be used.
Where professional electrical work is required by applicable law or by the installation circumstances, the customer must use a suitably qualified professional.
Mirqavo shall not be responsible for damage resulting from unauthorized modification, improper installation, misuse, failure to follow the manufacturer's instructions or use contrary to applicable safety requirements, except where liability cannot legally be excluded.
4. Product Safety
Customers must inspect products before use and must follow all safety instructions supplied with the product.
A product that appears damaged, cracked, electrically unsafe or otherwise defective must not be used.
In particular, a damaged mirror containing electrical components should not be connected to an electrical supply.
Customers should contact Mirqavo promptly if they believe that a product presents a safety issue or may be defective.
Nothing in these Terms limits any mandatory product-safety or consumer-protection rights.
5. Orders
Customers may place orders through the Mirqavo website by following the online ordering process.
Before submitting an order, customers will have the opportunity to review the products, quantities, delivery information and total price.
The customer is responsible for ensuring that all information supplied during checkout is correct.
An order confirmation email does not necessarily constitute acceptance of an order unless expressly stated otherwise.
We reserve the right to refuse or cancel an order where permitted by applicable law, including in circumstances such as:
- obvious pricing or product description errors;
- suspected fraudulent activity;
- inability to obtain the ordered product;
- technical errors;
- delivery restrictions;
- payment problems; or
- circumstances outside our reasonable control.
If payment has already been made for an order that we cancel, the relevant amount will be refunded.
6. Prices
All prices displayed on the website are stated in the currency shown at checkout.
Where legally required, applicable taxes will be included in the displayed price.
Shipping costs, where applicable, will be displayed before the customer submits the order.
Mirqavo reserves the right to change prices at any time. Price changes will not affect orders that have already been accepted, except where correction of an obvious pricing error is permitted by applicable law.
7. Payment
Available payment methods are displayed during checkout.
Payment must be successfully authorized before an order is processed, unless another payment arrangement has been expressly agreed.
Mirqavo does not store complete payment card details where payment is processed through an external payment provider.
Payment providers may apply their own terms and privacy policies.
8. Delivery
Mirqavo currently intends to ship products from Germany to customers located in Germany and other European Union countries.
Available delivery methods and estimated delivery times are displayed during checkout or on the relevant shipping information page.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
Delivery may be delayed due to circumstances outside our reasonable control, including carrier delays, severe weather, strikes, customs procedures, technical failures or other events beyond our control.
We will make reasonable efforts to keep customers informed of significant delivery problems.
9. Delivery Address
The customer is responsible for providing a complete and accurate delivery address.
If a delivery fails because the customer provided incorrect or incomplete information, additional delivery costs may arise.
Where legally permitted, the customer may be responsible for reasonable additional costs resulting from an incorrect delivery address.
10. Damaged Packages and Products
Because mirrors are fragile products, damage during transportation may occasionally occur.
Customers should inspect the package and product as soon as reasonably possible after delivery.
If a mirror arrives damaged, the customer should contact Mirqavo as soon as possible and provide:
- the order number;
- photographs of the outer packaging;
- photographs of the internal packaging;
- photographs of the damaged product;
- photographs of any visible shipping damage; and
- any other information reasonably requested to investigate the incident.
Customers should retain the original packaging until the matter has been resolved, where reasonably possible.
Mirqavo may use photographs, videos, packaging information and other evidence to investigate the damage and, where appropriate, pursue a claim against the carrier or supplier.
Where a product is damaged during transportation, Mirqavo will provide an appropriate remedy in accordance with applicable law, which may include replacement, repair, price reduction or refund, depending on the circumstances and the customer's applicable legal rights.
Nothing in this section requires a consumer to waive or lose mandatory statutory rights merely because particular evidence could not be provided.
11. Returns and Right of Withdrawal
Consumers within the European Union may have a statutory right to withdraw from a distance contract within the applicable legal withdrawal period.
The withdrawal period and conditions applicable to a particular order will be explained in Mirqavo's separate Withdrawal and Returns Policy.
Nothing in these Terms limits or excludes any mandatory statutory right of withdrawal.
12. Returns of Products
Unless an applicable legal exception applies, returned products should be:
- safely packaged;
- returned with reasonable care;
- accompanied by the relevant order information; and
- returned within the applicable withdrawal or return period.
Customers should use appropriate packaging when returning mirrors because mirrors are fragile.
Customers may be responsible for any legally applicable reduction in the value of a product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
Any such reduction will only be claimed to the extent permitted by applicable law.
13. Refunds
Where a refund is legally or contractually due, Mirqavo will process the refund using the original payment method unless another method has been agreed.
Refund timing may depend on the payment provider and banking system.
Where applicable law permits a refund to be withheld until the returned goods have been received or the customer has provided evidence that the goods have been returned, Mirqavo may exercise that right.
14. Defective or Non-Conforming Products
If a product is defective, damaged or does not conform to the contract, customers should contact Mirqavo with the order number and a description of the issue.
Customers may have statutory rights relating to defective or non-conforming products.
Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction or cancellation/refund.
Nothing in these Terms restricts mandatory statutory consumer rights.
15. Manufacturer's Warranty
Unless expressly stated otherwise on the product page or accompanying documentation, Mirqavo does not provide an additional voluntary commercial warranty beyond any warranty or guarantee expressly offered by Mirqavo.
This does not affect mandatory statutory consumer rights.
Where a manufacturer provides a voluntary warranty, the applicable manufacturer warranty terms may apply in addition to the customer's statutory rights.
16. Installation and Mounting
Mirqavo sells mirrors but does not provide installation or mounting services unless expressly stated otherwise for a particular product.
The customer is responsible for ensuring that:
- the wall or mounting surface is appropriate;
- the appropriate mounting hardware is used;
- the product is installed according to the manufacturer's instructions;
- the mounting system is suitable for the weight and dimensions of the mirror;
- electrical connections are used safely; and
- professional assistance is obtained where required.
Mirqavo does not accept responsibility for damage caused solely by incorrect customer installation, improper mounting, unsuitable walls, unsuitable mounting hardware, unauthorized modifications or failure to follow supplied instructions, except where such limitation is prohibited by applicable law.
17. Proper Use
Mirrors must be used only for their intended purpose and in accordance with the manufacturer's instructions.
Customers must not:
- modify electrical components;
- remove safety components;
- use damaged electrical components;
- expose products to conditions for which they are not designed;
- use unsuitable cleaning products that may damage surfaces or electrical components; or
- use the product contrary to the supplied safety instructions.
18. Cleaning and Maintenance
Customers should follow the manufacturer's cleaning and maintenance instructions.
Electrical components should not be exposed unnecessarily to water or other liquids.
Before carrying out cleaning or maintenance involving electrical components, customers should follow the manufacturer's safety instructions.
19. Availability
We aim to maintain accurate stock information.
However, inventory information may occasionally be inaccurate due to technical errors, simultaneous orders or supplier-related issues.
If a product becomes unavailable after an order has been placed, Mirqavo will inform the customer and provide the applicable remedy, including a refund where appropriate.
20. Third-Party Manufacturers and Suppliers
Mirqavo may source products from third-party manufacturers and suppliers.
The fact that a product is manufactured by a third party does not remove any mandatory rights or obligations applicable to the sale between Mirqavo and the customer.
Product documentation, manufacturer information and safety instructions may originate from the manufacturer.
21. Intellectual Property
All content on Mirqavo.com, including logos, text, graphics, photographs, website design and other materials, is protected by applicable intellectual property laws unless otherwise stated.
Customers may not reproduce, distribute, modify or commercially exploit Mirqavo content without appropriate authorization.
Third-party trademarks and product names remain the property of their respective owners.
22. Website Use
Customers must not use Mirqavo.com for unlawful purposes or attempt to interfere with the security, operation or availability of the website.
We may temporarily suspend website functionality for maintenance, security reasons, technical problems or other legitimate reasons.
23. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence where such limitation is prohibited;
- intentional misconduct;
- gross negligence where liability cannot legally be excluded;
- fraudulent conduct;
- mandatory product liability;
- breach of mandatory consumer rights; or
- any other liability that cannot legally be excluded or limited.
Subject to the above, Mirqavo shall only be liable for losses that are legally attributable to Mirqavo under the applicable law.
24. Force Majeure
Mirqavo shall not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, governmental restrictions, strikes, major transport disruptions, cyber incidents, supplier failures or significant technical failures.
This section does not remove any mandatory consumer rights that apply to the contract.
25. Complaints
Customers who have a complaint should first contact Mirqavo using the contact information published on the website.
We will make reasonable efforts to investigate and resolve complaints promptly and fairly.
26. Business Customers
Where a customer purchases products for business or commercial purposes, mandatory consumer protections that apply exclusively to consumers may not apply.
Business customers are responsible for providing accurate company and billing information where required.
Nothing in these Terms affects mandatory provisions of applicable commercial law.
27. Privacy
Personal information is processed in accordance with Mirqavo's Privacy Policy.
The Privacy Policy explains what information is collected, why it is processed, how it is stored and what rights individuals may have.
28. Cookies
Mirqavo may use cookies and similar technologies.
Information regarding cookies and consent choices is provided through the website's Cookie Policy and cookie-consent mechanism.
29. Governing Law
These Terms shall be governed by the applicable law, subject to mandatory consumer protection provisions applicable to the customer's place of residence.
Where the customer is a consumer, nothing in this clause deprives the consumer of mandatory rights provided by the laws that apply to their consumer contract.
For business customers, the applicable jurisdiction may be determined in accordance with the applicable commercial law and any valid contractual agreement.
30. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
The invalid provision shall be replaced or interpreted in accordance with applicable law to the extent necessary.
31. Changes to These Terms
Mirqavo may update these Terms from time to time.
The version applicable to an order will generally be the version available at the time the relevant contract was concluded, subject to mandatory legal requirements.
